General Terms and Conditions (GTC) for participants in online language courses offered by the FS International GmbH offered

Part I: General regulations for all types of language courses

• 1 Scope

(1) These terms and conditions apply to all language courses offered by the FS International GmbH (hereinafter „FS International“called”). This includes exclusively online courses conducted via electronic communication means.

(2) FS International provides all teaching and other services within the framework of current and future business relationships exclusively on the basis of these General Terms and Conditions in their version valid at the time of conclusion of the contract and published on the website https://fachkraft.supply/agb Published version. The General Terms and Conditions of FS International apply exclusively to the contractual relationship. Any conflicting terms and conditions, including any contradictory terms and conditions of contractual partners, are not applicable. This also applies even if FS International has not expressly objected to the application of these differing terms and conditions in a specific case.

(3) For the sake of readability, gender-specific differentiation is omitted in these Terms and Conditions. Where the term "participants" is used, it applies equally to all genders and also to legal entities.

• 2. Conclusion of the contract

(1) The announcement of language courses by FS International This is non-binding. Therefore, a participant's booking of a language course does not yet constitute a contract. Rather, the contract only comes into effect when... FS International:

• a) the registration for the booked course is confirmed within a period of two weeks either in text form or in writing, or
• b) has not informed the participant of the cancellation of his or her booking within two weeks of the booking being made.

(2) If the language course has already started at the time of booking, the contract shall, notwithstanding paragraph 1, only be valid if a booking confirmation is issued in text form or in writing by FS International This is the case. Paragraph 1(b) does not apply in this case.

(3) The language of the contract is German.

• 3 Right of withdrawal

(1) You have the right to fourteen days without giving reasons to cancel this contract. The cancellation period is fortnight from the day the contract is concluded.

Cancellation of a booked course must be made in writing. The following fees will be charged: 

• Cancellation up to 14 days before the course starts: €150 
• Cancellation up to 7 days before the course starts: €250 
• After that, no refund is possible.

Consequences of the revocation:
If we have already provided services before the cancellation, you must pay appropriate compensation that corresponds to the ratio of the services already provided to the total service.

(2) Courses are booked for a predetermined period or a specific number of hours. If the hours are not attended or are interrupted, there is no entitlement to a refund of the course fee. This does not affect the statutory right of withdrawal.

(3) If you cancel this contract, we will refund all payments received from you., to be repaid immediately and at the latest within fourteen days from the day, The refund will be issued on the date we receive your written notification of cancellation of this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this refund.

• 4 Contracting parties and participants

(1) The contract for participation in the language course creates contractual rights and obligations only between FS International and the person who books the course, as the contractual partner of FS International.

(2) The person booking the language course may also make the booking for another participant. This third person must be named at the time of booking. In this case, they will have the right to participate in the language course instead of the person booking the course. All other rights and obligations arising from the concluded contract, insofar as they are not directly related to personal participation in the course, exist independently only between FS International and the person booking the language course.

(3) If a person other than the one for whom the language course was booked is to participate in the course, this requires the consent of FS International. FS International will grant approval unless there are objective reasons to the contrary.

• 5. Course Implementation, Organizational Changes

(1) FS International reserves the right to cancel courses due to insufficient enrollment. In this case, refunds will be issued. FS International the pro rata course fees attributable to the cancelled teaching units.

(2) The minimum number of participants for a language course is 8 persons. If this number falls below the minimum during the course, the course will be cancelled. If this is unreasonable for the participant due to compelling, objective reasons that they must demonstrate, they may terminate the contractual relationship within a preclusive period of two weeks after being assigned to the other course. (4) If a teacher is absent, FS International We will try to provide a substitute teacher. If this is not possible, the lesson can be made up – although there is no entitlement to this. Refunds will be issued at the end of the course. Further claims, including claims for damages, are excluded.

(5) FS International is not liable for the achievement of any specific learning or teaching outcome.

• 6 changes

(1) The range of online courses is provided by the FS International GmbH Continuously updated and expanded. Despite careful planning, content changes may be necessary in individual cases. FS International therefore reserves the right to make necessary content-related and methodological adjustments or deviations from the course description, provided these do not significantly alter the topic and overall character of the online course in question.

• 7 Copyright; Right of Use

(1) FS International is the owner of all rights of use of all content available within the framework of the online courses, in particular texts, videos and the downloadable course materials.

(2) The participant receives a simple, non-exclusive right to use the available content of the online course. Without prior written permission, the participant is prohibited from reproducing, processing, copying, distributing, publicly displaying, or otherwise processing the texts, videos, or other content in any form, including for teaching purposes. The participant must ensure that the course materials are not passed on to third parties.

(3) Participants are permitted to save and print the downloadable content on a local hard drive for their own use. Saving the media to a network drive or similar online service (cloud) is not permitted.

(4) Participants are prohibited from photographing, filming, or recording the course, in whole or in part, and/or storing it on data carriers. Received course materials may not be reproduced, distributed, or otherwise publicly disseminated without the written permission of FS International or the respective course instructor.
